Can an Employer Reject a Medical Certificate in India?

A valid medical certificate — issued by a registered doctor, in person or via telemedicine — cannot be dismissed by an employer just because they're unfamiliar with how it was issued. Here's what the law actually allows, and what doesn't count as valid grounds for rejection.

What the Law Says

Under the MoHFW Telemedicine Practice Guidelines 2020 (GSR 225(E), Gazette of India, 25 March 2020), a certificate issued by a registered medical practitioner after a telemedicine consultation carries the same legal standing as one issued in person. There is no separate labour law provision that lets an employer reject a certificate purely because it was issued online.

Most company leave policies require a certificate to state the doctor's name, qualification, registration number, diagnosis, and recommended rest period. If a certificate includes all of these, it meets standard documentation requirements.

Valid Grounds for an Employer to Question a Certificate

  • Missing or unverifiable doctor registration number
  • Inconsistent dates (e.g. certificate dated after the leave period)
  • Certificate doesn't match the company's stated documentation policy
  • Pattern of frequent, short-notice sick leaves — employer may request a second medical opinion, not outright reject the certificate

What Isn't a Valid Reason to Reject

  • "We don't accept online/telemedicine certificates" — not legally defensible on its own
  • Certificate issued by a doctor outside the employee's city or state
  • Personal doubt without a documented, specific reason

How to Make Sure Your Certificate Can't Be Disputed

  • Get it from an NMC-registered doctor — verifiable at nmc.org.in
  • Make sure it includes diagnosis and recommended rest period, not just "unwell"
